New Approved Contracts to transfer data from the EU
On June 4, 2021, the European Commission approved new Standard Contractual Clauses (SCCs) to govern the transfer of personal data. The SCCs have been updated to reflect the GDPR and the Schrems II decision.
- New SCCs can be used starting from June 27, 2021
- Old SCCs can no longer be executed from September 27, 2021
- Old SCCs must be replaced with the new SCCs BEFORE December 27, 2022.
Given that the new SCCs must be used starting from September 27, 2021, everyone must start reviewing and understanding the requirements for the SCCs, and begin updating your documentation, such as DPAs and SCCs.
