More and more of a business’s value resides in its intellectual property, like its patent applications and granted patents.  Patent applications, however, often are filed without considering how they fit into your business’s strategy.  At Henry Park Law, our patent attorneys in New York, New Jersey and the surrounding states will work closely with you to provide business directed patent strategies that are cost-effective for growth and collaboration (e.g., licensing, merger and acquisition, etc.).

1. Patent Search and Opinion

A patent search is a search of patent applications, patents, and other printed publications to identify whether your invention is novel and non-obvious. Moreover, a patent search is valuable because it can save you time and money from pursuing an invention that is not patentable or for which you could not obtain meaningful protection.

Our attorneys have years of experience and significant resources to perform a patent search.  After the search is completed, we will review the search results and provide you with our legal opinion concerning your chance of successfully obtaining a patent.

2. Filing and Prosecuting a Patent Application

Our patent attorneys will work closely with you to understand your invention, draft the patent application specification and patent claims to capture your invention, file your patent application, and respond to the U.S. Patent & Trademark Office Actions. Once your patent is granted, you will have the right to exclude others from making, using or distributing your invention.

Depending on your business strategy, we may advise that you file a provisional patent application, which is a temporary one-year place-holder, or file a non-provisional patent application.

Additionally, depending on your business plans, we can help you pursue patent protection from foreign patent offices.

3. Maintenance Fees

After being granted a patent, you have to pay periodic maintenance fees to keep the patent in force.  We can help you track these fee deadlines, and to make sure that your patent stays in force.
